Safe and Just: Balancing the Rights of Accused/Perpetrators, Victims and their Families in Conditions in Criminal and Family Proceedings related to Intimate Partner Violence
Background
In 2017, Basil Borutski was convicted of the murder of Anastasia Kuzyk, Nathalie Warmerdam and Carol Culleton. When he committed the murders in 2015, he had been on probation for choking Kuzyk multiple times. Recommendation 60 of the Renfrew Coroner’s Inquest into the deaths of the 3 women reflected concern that appropriate and suitably enforced release conditions could have played a role in preventing the women’s deaths. It recommended a review of how release conditions are drafted, that included the input of community members and Service providers for those experiencing Intimate Partner Violence (IPV).
CALC and its partners are undertaking a study to respond to this call, exploring the experience and perspective of IPV Service providers in one of Canada’s regions with the highest levels of IPV. It will explore these subject matter experts’ insights into how release conditions are experienced by victims, their children and families, the accused/perpetrator and the community. It also examines factors and approaches that may be recommended by participants for a more effective, just and safe system of conditions in the future.
